It is not always necessary to name every child individually. Depending on your wishes, your Will may instead refer to a group such as “my children”. If you have a blended or joined family, please tell us clearly who you intend to include.

If a stepchild has not been legally adopted by you, please do not assume that a reference simply to “my children” will include them. Tell us what you would like to achieve and we can clarify the wording during drafting.

Tell us who you would like to receive the remainder of your estate after debts, expenses and any specific gifts have been dealt with.

If you choose “My children”, we will use your family information and instructions to understand who you intend to include. If you are unsure, explain your wishes in your own words and ask us during drafting.

Who should deal with your estate?

An executor is responsible for dealing with your estate and carrying out the instructions in your Will. An executor can also be someone who inherits from you.

You only need to appoint one executor. If you appoint only one, it is sensible to consider naming an alternative executor in case your chosen executor is unable to act. Some people appoint two or more executors, particularly where they want their children to act together. You can name up to four executors on this form, although a smaller number is often preferable because appointing too many can make the process slower and more complicated.

The person or people dealing with the estate may also act as trustees where the Will creates a continuing trust. The legal roles are distinct, and the final arrangements will be dealt with in the Will.

Standard drafting begins after the applicable cooling-off period; Expedited drafting can begin sooner if you specifically request it in writing. Either way, you will have the opportunity to check the draft, ask questions and request alterations before your final Will is prepared.
