Terms and Conditions

These Terms and Conditions explain the basis on which Wise Wills provides its Will-writing and drafting service. Please read them carefully before placing an order and before asking us to begin drafting your Will.

1. About the service

Wise Wills provides a personalised Will-writing and drafting service. The service is not simply the sale of a generic document template.

We use the information and instructions you provide to prepare a draft Will for you to review. You will have the opportunity to check the draft, ask questions and request reasonable alterations before the final Will is prepared.

Our straightforward service is intended for circumstances that can reasonably be dealt with within the scope of the service we offer.

2. Your instructions and information

You must be 18 or over and have the necessary mental capacity to make a Will.

The instructions used to prepare your Will must represent your own wishes.

During the drafting process, you are responsible for providing accurate and complete information and, where a person is to be individually named in your Will, their correct full name and spelling.

For example, if someone is commonly known as “Paddy” but their full name is “Patrick”, you should provide their correct full name rather than simply the name by which they are commonly known.

It is not always necessary to name every person individually. Depending on your wishes and the wording of your Will, you may choose to refer to a class of people, such as “my children”, rather than naming each child separately. This may include your biological or legally adopted children, including relevant children born or legally adopted by you after your Will is made, depending on the wording used.

However, every family is different. If you have a blended or joined family, it is important that you make clear exactly whose children you intend to include. A reference to “my children” may not automatically include stepchildren who have not been legally adopted by you.

If you prefer particular children or other members of your family to be individually named or expressly included, you may choose to do so. You are responsible for making your wishes clear so that your Will can accurately reflect who you intend to include.

We may ask you to provide an address or other information as part of your instructions. However, we do not usually include a person's address in the Will itself. Addresses can change, and including them unnecessarily may mean that the Will needs to be updated simply because someone has moved. We may ask for address information to help us understand and clarify your circumstances and, where relevant, establish whether you are living in the UK and within the scope of our service.

You are responsible for carefully checking each draft before approving it to make sure that your personal details, instructions, and the names or descriptions of the people referred to in your Will accurately reflect your wishes.

3. Single Wills and Mirror Wills

A Single Will is prepared for one person.

Mirror Wills are two separate Last Wills and Testaments — one for each person. Although the Wills may contain similar or corresponding instructions, each Will is a separate legal document belonging to the individual making it.

Each person must provide or confirm their own instructions and must have the opportunity to check their own draft.

Each person must separately sign and have their own Will witnessed correctly in accordance with the signing instructions provided. One person's signature does not make the other person's Will valid.

Mirror Wills are not necessarily identical in every respect. Each person remains responsible for their own Will and may have different wishes where appropriate.

4. Drafting and amendments

Once we have considered your instructions, we will prepare a draft Will for you to review.

You may ask questions, raise concerns and request alterations during the draft process. Further drafts may be prepared where reasonably necessary to ensure that the Will properly reflects your instructions.

If your circumstances or instructions change substantially during the drafting process, please tell us as soon as possible. We can then discuss the position with you before further work is undertaken.

If a change takes the Will outside the scope of the straightforward service originally ordered, we will explain this to you before proceeding further.

5. Approval and preparation of the final Will

The final Will will normally be prepared once you have had the opportunity to review the draft and confirm that it reflects your wishes.

For Mirror Wills, two separate final Last Wills and Testaments will be prepared — one for each person.

The completed Will or Wills will be supplied to you with the appropriate signing and witnessing instructions.

6. Signing and witnessing your Will

It is important that your completed Will is signed and witnessed correctly.

Although Wise Wills will provide signing and witnessing instructions, you remain responsible for ensuring that your own Will is signed and witnessed correctly in accordance with those instructions and the applicable legal requirements.

At the witnessing stage, Wise Wills cannot know, and does not need to know, who your witnesses will be. You are therefore responsible for ensuring that the names of the witnesses, and any other information required during the signing and witnessing process, are recorded correctly in accordance with the signing instructions provided.

For Mirror Wills, each person must separately sign their own Will and ensure that it is witnessed correctly. The execution of one person's Will does not execute or validate the other person's Will.

A Will may not take legal effect as intended if it is not properly signed and witnessed.

7. Scope of the service

Wise Wills aims to provide a straightforward, personalised Will-writing service for circumstances that can reasonably be dealt with within the scope of the service.

Some circumstances may require specialist consideration or advice that falls outside that scope. This may include, for example, complex family, financial, business, trust, tax, overseas or other specialist circumstances.

If, while considering your instructions, we believe that your requirements cannot reasonably be dealt with within the service, we may ask for further information, decline to proceed with that particular instruction or explain that you should consider obtaining appropriate specialist advice.

We will not knowingly present specialist legal, tax or financial advice as part of the straightforward Wise Wills service.

8. Prices

These prices apply to the straightforward service described on the Wise Wills website and are subject to the instructions and circumstances remaining within the scope of that service.

Any applicable discount or promotional offer will be explained separately.

20% goodwill discount

Wise Wills offers a 20% goodwill discount to NHS staff, emergency service personnel and members of the Armed Forces. This offer operates on trust. No proof or verification is required.

9. Payment and acceptance of these Terms

Before drafting begins, you must confirm that you accept these Terms and Conditions.

Your acceptance of these Terms is separate from any statutory cancellation or cooling-off rights that may apply to an online consumer contract.

Payment and the process for placing an order are explained during the Wise Wills order journey.

10. Standard and Expedited Drafting

Wise Wills offers a Standard process and an option to request Expedited Drafting.

Under the Standard process, drafting will normally wait until the applicable consumer cooling-off period has ended.

If you would like drafting to begin sooner, you may request Expedited Drafting in writing. Before early performance begins, you will be given the information and any acknowledgement required in relation to your cancellation rights.

Requesting Expedited Drafting does not, by itself, remove any statutory cancellation rights. The effect on those rights will depend on the applicable law and the stage reached in the performance of the service.

11. Completion of the service

For the purposes of the Wise Wills drafting service, the preparation and supply of a draft does not mean that the service has been completed.

The service is normally complete when the final Will has been prepared following your approval of the draft and securely supplied to you.

For Mirror Wills, the service normally involves the preparation and supply of two separate final Wills, one for each person.

12. Cancellation rights

If you purchase the Wise Wills service online as a consumer, you may have statutory cancellation rights.

The applicable cancellation arrangements, including the normal cooling-off process and the position where you ask Wise Wills to begin providing the service before the end of that period, are explained on our Cancellation page and during the order process.

Nothing in these Terms is intended to remove or restrict any cancellation rights that cannot lawfully be excluded.

13. Complaints

If you are unhappy with any aspect of the Wise Wills service, please contact us so that we have the opportunity to understand and address your concerns.

14. Our responsibilities

Wise Wills will provide its service with reasonable care and skill.

Nothing in these Terms is intended to exclude or limit any legal responsibility that cannot lawfully be excluded or limited.

15. Your responsibility to check the final document

Before signing your Will, you should carefully check the final document to ensure that it reflects your wishes and that the relevant information is correct.

If you have any questions or concerns about the wording or effect of your Will before signing it, you should raise them before execution.

You should also follow the signing and witnessing instructions supplied with your Will.

16. Keeping your Will under review

Your Will reflects your circumstances and wishes at the time it is prepared. You should consider reviewing your Will if your circumstances or wishes change significantly after it has been signed.

For example, you should review your Will if you marry, enter into or dissolve a civil partnership, divorce, have children, or if there are significant changes to your family, beneficiaries, executors, financial circumstances or wishes.

Marriage or entering into a civil partnership can affect the validity of an existing Will. Divorce or dissolution can also affect how an existing Will operates.

If you are unsure whether a change in your circumstances may affect your Will, you should consider seeking appropriate advice.

17. Changes to these Terms

The Terms and Conditions that apply to your order will normally be those presented to you at the time you place your order or otherwise accept the service terms.

If Wise Wills makes changes to its website Terms in the future, those changes will not normally alter the terms already agreed for work that has already been accepted, unless a change is required by law or is separately agreed with you.
